Subject:                          maintenance-of-effort question

Dear Melba:

This is a response to the letter we received from Superintendent Burnham.

In his letter the Superintendent asked us to contact you about whether Mississippi has the U.S. Department of Educationís (ED) prior approval to count expenditures of State Fiscal Stabilization Funds towards the Elementary and Secondary Education Actís maintenance-of-effort (MOE) requirements.  If Mississippi maintains auditable data showing that it meets the two criteria listed in Question C-6b of EDís Title I, Part A ARRA Guidance [available at: http://www2.ed.gov/policy/gen/leg/recovery/guidance/title-i-rev-201003.doc], the State has EDís prior approval to count SFSF expenditures for this purpose.

I hope this information is helpful.

Best regards,

Todd
